EB-5 IMMIGRANT INVESTOR PROGRAM

The EB-5 immigrant investor program, administered by U.S. Citizenship and Immigration Services (“USCIS”), offers foreign nationals the opportunity to become permanent residents of the United States by investing capital in a job-creating U.S. enterprise. To qualify for the program, the investment must create jobs for U.S. workers. The minimum amount prescribed by Congress for an EB-5 investment is $1 million, unless the U.S. enterprise qualifies for a reduced investment amount of $500,000 as a result of being located in a qualifying rural area or a designated area of high unemployment.



Business owners and EB-5 project developers may benefit from an infusion of foreign capital if implementation of their business plans can result in the creation of new, permanent U.S. jobs at a rate of 10 full-time jobs per investor. Where the invested capital is intended to revitalize a troubled business, job preservation may be an acceptable substitute for new job creation. Affiliation of the U.S. enterprise with a USCIS-approved “Regional Center” may enable the project to demonstrate, with economic projections, that the implementation of the business plan will create jobs indirectly, throughout the regional economy, as well as directly within the enterprise itself.
